Designer Terms of Service

Last updated: 2026-05-23 · Effective immediately upon use of the Designer.

These terms govern use of the Custom Board Designer at cornholeboards.us/designer(the “Designer”), the gallery at cornholeboards.us/gallery, and any related printing, shipping, and content-distribution features. The Designer and these services are operated by Tuxxin LLC(“we,” “us,” “our”).

1. Acceptance

By clicking Accept & continue on the Designer entry modal, by using the Designer in any way, or by purchasing a print or shipment, you confirm that you have read, understood, and agree to these terms. If you do not agree, do not use the Designer.

2. Prohibited content

You agree not to upload, create, save, publish, print, or ship any design that contains Prohibited Content.

Prohibited content includes, without limitation:

Full or partial nudity of any kind, sexual imagery, or pornography.
Racist, hateful, or discriminatoryimagery, symbols, slurs, or language — including content targeting race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
Anything reasonably considered offensive, including but not limited to gratuitous violence, gore, harassment, doxxing, glorification of self-harm, or attacks on identifiable individuals.
Imagery infringing third-party trademarks, copyrights, or rights of publicity.

We use automated content-moderation tooling at the point of purchase. Designs flagged by our moderation may be held, cancelled, or referred for manual review at our sole discretion. The $3 “Keep private” upsell is required for any purchase whose design our moderation flags as potentially containing nudity or other adult content; designs flagged for racist, hateful, or otherwise offensive content cannot be made private and will be cancelled regardless of payment.

3. Public gallery

Designs you purchase are by default added to our public Gallery after the initial 72-hour draft window expires. Other signed-in users can vote on, favorite, purchase a copy of, or use your design as a starting template for their own work. You may opt out per-design from My designs or by paying the $3 Keep-Private upsell, which removes the design from the gallery permanently.

4. Reservation of rights

CornholeBoards.us, operated by Tuxxin LLC, reserves the absolute right, at our sole discretion and without prior notice, to:

Deny or cancel any order;
Delete any design (purchased or unpurchased);
Suspend or permanently terminate any account;
Withhold refunds for cancelled orders involving Prohibited Content;
Refuse future service to any user.

We may take these actions whether or not the content has been published, printed, or shipped. We are not required to provide a reason. We are not required to provide warning. We are not required to return your design files or any payment you have made for a design containing Prohibited Content.

5. Indemnification

You agree to indemnify, defend, and hold harmless Tuxxin LLC, its officers, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or relating to your use of the Designer, your submitted content, or your violation of these terms.

6. Legal recourse

Where a user’s submission, publication, or attempted publication of Prohibited Content causes damage to CornholeBoards.us’s reputation, customer relationships, or commercial standing, we reserve the right to pursue legal remedies — including civil action for damages, injunctive relief, and recovery of attorney’s fees — under the laws of the State of Florida.

By using the Designer you consent to the exclusive jurisdiction and venue of state and federal courts located in Florida for any dispute arising from your use of the Designer or this Service. You waive any objection based on personal jurisdiction, forum non conveniens, or improper venue.

7. No warranty

The Designer is provided “as is” without warranty of any kind. We do not guarantee that the Designer will be available at all times, that designs will print identically to on-screen previews, or that moderation will catch all Prohibited Content. You use the Designer at your own risk.

8. Limitation of liability

To the maximum extent permitted by Florida law, Tuxxin LLC’s aggregate liability for any claim arising from your use of the Designer or any related service shall not exceed the total amount you have paid us in the twelve months preceding the claim, or one hundred dollars (USD $100), whichever is greater.

9. Changes to these terms

We may update these terms at any time by posting a revised version at this URL. Continued use of the Designer after a change constitutes acceptance of the updated terms.
